Ketanji Brown Jackson Expresses Concern Over First Amendment Limiting Government

During oral arguments in a case about government censorship on social media, Supreme Court Justice Ketanji Brown Jackson expressed concern that the First Amendment is overly restricting the government’s ability to respond to emergencies.

When the state of Louisiana argued the government cannot coerce platforms to remove content, Jackson countered some situations may require the government to “encourage or require” censorship for public safety.

Conservatives have opposed the White House pressuring private companies to suppress information like vaccine skepticism or political speech.

Jackson’s comments suggest she believes governments should have more leeway to restrict speech during crises than current First Amendment jurisprudence allows.

The case centers on the balance between government authority and free expression rights on digital platforms.
